1. Agreement and parties
These Terms of Use and Software License (the Terms) are a legally binding agreement between you and Kimi Chen, a California sole proprietor doing business as EverPacket (EverPacket, we, us, or our). They govern your access to and use of the EverPacket website, progressive web application, account features, locally installed or cached application components, project-file format, generated outputs, support services, and related features (collectively, the Service).
The business mailing address for EverPacket is 8843 Villa La Jolla Drive Apt 2, La Jolla, CA, 92037. Product-support inquiries may be sent to support@everpacket.com.
When a purchase is processed through Stripe Managed Payments, the Payment Merchant—the legal entity identified by Stripe or Link at checkout and on the receipt—is the merchant of record for that transaction. The Payment Merchant sells and processes the transaction and handles payment collection, transaction-related tax, fraud controls, payment disputes, receipts, and merchant-of-record support under its own terms. EverPacket remains the software operator, provider, and licensor and is responsible for the product, activation, account functions, product support, and the privacy commitments in EverPacket’s own policies.
2. How you accept these Terms
You accept these Terms when you do any of the following:
affirmatively check a box or select a button stating that you agree to them;
create or finish setting up an EverPacket account after being presented with them;
complete a purchase after being presented with them; or
continue using a part of the Service for which applicable law recognizes acceptance by use, after receiving clear notice of the Terms.
For the free emergency-sheet experience, EverPacket presents a separate Free Use Terms acceptance. The Free Use Terms supplement these Terms and control only to the extent they give you a more specific right for free use. The Privacy Policy, Refund, Cancellation and Withdrawal Policy, Digital Product, Delivery, Compatibility and Local-Storage Disclosure, Cookie and Device-Storage Notice, Consumer Health Data Privacy Notice, and Global Consumer Rights Addendum are incorporated into these Terms by reference.
Before you are sent to the Payment Merchant, the purchase review must present the then-current Terms, Privacy Policy, and Refund Policy and make the incorporated Digital Product, Delivery, Compatibility and Local-Storage Disclosure, Cookie and Device-Storage Notice, Consumer Health Data Privacy Notice, and Global Consumer Rights Addendum reasonably available. The Free Use Terms use a separate free-feature acceptance, and the Accessibility Statement is published for information rather than treated as purchase consent. EverPacket’s records distinguish documents you affirmatively accept or acknowledge from documents incorporated by reference or published for information. A material change is not retroactively imposed on a completed transaction unless applicable law permits it and you receive any notice or consent opportunity required by law.
3. Eligibility and consumer use
You must be at least 18 years old or the age of legal majority where you live to create an account, purchase EverPacket Full, or accept these Terms on your own behalf. A person below the age of majority may use the Service only under the supervision of a parent or legal guardian who accepts these Terms and is responsible for the use.
The Service is not directed to children under 13 and is not designed for school, childcare-provider, or child-directed commercial use. Do not create an account for a child or submit a child's email address as the account identity.
EverPacket is designed principally for personal and household use. Business, professional, institutional, government, healthcare-provider, financial-institution, or fiduciary use requires our prior written approval and may require separate terms.
4. What EverPacket is - and is not
EverPacket is organizational software that helps you record household-continuity information, review it, and generate focused handoff documents such as an emergency sheet, household packet, situation-specific PDF, QR payload, or contact card.
EverPacket is not:
a password manager, credential vault, encrypted cloud drive, backup service, or document custodian;
a medical-record system, healthcare service, emergency-dispatch service, or substitute for professional medical advice;
a legal-document generator, estate-planning service, financial advisor, bank-data aggregator, insurance advisor, or substitute for professional legal, tax, financial, or insurance advice;
a monitoring, collaboration, dead-man-switch, or guaranteed-notification service; or
a guarantee that a household plan is complete, current, lawful, safe, or appropriate for any particular emergency.
You are responsible for deciding what information is appropriate to record, reviewing it for accuracy, obtaining professional advice where needed, and keeping emergency contacts and official instructions available through appropriate channels.
5. Local-first architecture and separation of account data from packet data
Through ordinary product operation, the editable contents of a packet are designed to remain in the browser profile and device storage you use and in files or printouts you choose to create. Except for a permitted, content-free support image that you intentionally submit under Section 18, EverPacket’s servers are not designed to receive packet fields, .EverPacket project-file contents, generated PDFs, contact-card contents, QR payloads, packet titles, names, phone numbers, household locations, healthcare locations, notes, search text, or output contents.
An EverPacket account stores and restores account and purchase access; it does not synchronize, upload, back up, transfer, or restore packet contents. Signing in on another device may restore eligible paid access, but the packet itself must be moved using a project file you export and import.
The local-first boundary is an important product limitation. Clearing browser storage, using a temporary or private browser profile, losing or resetting a device, uninstalling a browser or app, changing browser profiles, storage eviction, device corruption, or deleting a local packet may permanently remove the only editable copy. EverPacket cannot restore packet contents that it never received.
6. Free access
Subject to these Terms and the Free Use Terms, EverPacket may provide a free experience that includes the current free packet workflow, a one-page emergency sheet, local editing, and project-file import or export as described in the Service. At initial launch, new access to the packet application, account creation, support submission, and free packet workflow is offered only through the approved United States experience, except for purchase activation and continuing customer access tied to a transaction fulfilled using a verified United States billing country. Outside that experience, EverPacket may provide only public information and legal pages, an optional unlinked country-interest count, and ordinary outbound social-profile links. We may change free-feature or geographic-availability limits prospectively, but we will not convert a completed one-time purchase into a recurring subscription without a new, explicit agreement.
Free access is licensed, not sold. It may require acceptance of a versioned Free Use Terms document. Optional analytics is not required to use free or paid features.
7. EverPacket Full and software license
After verified payment and required account activation, EverPacket grants you a personal, limited, non-exclusive, non-sublicensable, revocable only as permitted by these Terms, and generally non-transferable license to use EverPacket Full for your own personal or household purposes on devices you own or control.
The Full license includes, as made available in the then-current product:
all guided sections and the ability to maintain multiple local packets;
full, situation-specific, and custom PDF outputs;
review, gap, freshness, QR, contact-card, and handoff features;
portable project-file export and import; and
updates included in the generally available product edition, together with any security, compatibility, conformity, or other updates we are legally required to provide.
The license does not transfer ownership of the Service, source code, designs, trademarks, templates, prompts, file-format specifications, or other EverPacket intellectual property. It does not include a right to resell, host, white-label, rent, lease, sublicense, commercially exploit, scrape, reverse engineer except where a non-waivable law permits it, bypass access controls, or use the Service to develop a competing product.
A future edition that is clearly sold as a separate major product may require a separate purchase, except that we will continue to provide any updates, remedies, or compatibility measures required by mandatory law for your purchase.
8. One-time purchase; no subscription
Purchasing EverPacket Full is a one-time purchase of a software license at the price and currency displayed immediately before checkout; it does not transfer ownership of the software. It is not a recurring subscription and does not automatically renew.
The initial paid launch is limited to transactions for which the Payment Merchant verifies a United States billing country. EverPacket may use a Cloudflare-provided country signal only as a preliminary routing or availability check; that signal does not override the Payment Merchant’s final billing-country record. A verified paid transaction reported with a United States billing country will ordinarily be fulfilled even if the customer later accesses the Service while travelling or from another country. By purchasing, you represent that the billing and eligibility information you submit is accurate and that you are not using false information or technical circumvention to bypass the U.S. launch restriction. Marketing may display a United States base price, such as USD 19.99. The purchase review shows the product price before checkout, and the Payment Merchant may add or separately identify applicable sales tax and other amounts required by law. The final hosted checkout and Payment Merchant receipt control the amount charged. We will not add a recurring charge without a separate, affirmative agreement.
Promotional offers may have eligibility, quantity, time, region, or redemption limits. The checkout review must show the applicable price before you commit. If a reviewed offer changes or expires before checkout is created, the Service will require a fresh review rather than silently substituting a different price.
9. Payment Merchant and transaction support
For transactions processed through Stripe Managed Payments, the Payment Merchant identified at checkout and on the receipt is the merchant of record. Payment information is entered on the Payment Merchant's hosted checkout. EverPacket does not receive or store your complete card number, card security code, or online-banking credentials.
The Payment Merchant may collect payment-method, billing-country, tax, fraud-prevention, and transaction information under its own terms and privacy notice. EverPacket receives transaction information needed to verify payment and administer access, such as checkout email, order and payment references, amount, currency, status, tax or country information made available to us, refund or dispute status, and timestamps.
Contact EverPacket for product behavior, activation, account access, compatibility, generated outputs, and product support. Contact the Payment Merchant through the channel shown on the receipt for payment-instrument, invoice, tax, transaction, charge, or merchant-of-record support. Either party may route the request to the other when appropriate.
10. Digital delivery and activation
There is no physical shipment. Delivery consists of electronic access to the then-current web application and activation of the Full entitlement after the following steps are completed:
the Payment Merchant reports a verified successful payment;
the purchase is attached to an eligible EverPacket account using the checkout, activation, or verified recovery flow; and
the Service confirms the Full entitlement.
A successful payment made while signed out may remain in a paid-but-unactivated state until you finish account setup. The checkout email and secure recovery process are used to connect the purchase to an account. A browser claim cookie may help continue setup, but it is not itself a paid entitlement and expires.
Internet access is required for checkout, sign-in, payment verification, activation, account recovery, entitlement refresh, refunds, support email, and account changes. After the application has loaded and a valid entitlement receipt is available, supported local editing and local output functions may continue offline, subject to browser limits and any online authorization required by the current product during a refund window.
11. Accounts, sign-in, and recovery
EverPacket may support sign-in through email verification codes and, when enabled and displayed, third-party identity providers such as Google, Facebook/Meta, or Microsoft. A provider option may be temporarily unavailable while its production configuration, provider review, or approval is incomplete. EverPacket does not require you to use a provider button that is not displayed. A provider you select processes information under its own terms and privacy notice. You are responsible for maintaining control of your email account, identity-provider account, devices, and browser sessions.
Do not share authentication codes or recovery links. Tell us promptly if you believe an account or purchase has been compromised. We may require recent authentication, verified email control, transaction details, or other proportionate proof before exporting account data, changing recovery information, transferring a purchase, or deleting an account.
Account recovery restores account or purchase access; it does not recover packet contents. Recovery emails may be sent only to verified or purchase-associated addresses as permitted by the current recovery flow.
12. Your content and information about other people
You retain any rights you have in information you enter into a local packet and in outputs you generate. Because EverPacket is not designed to receive packet contents, you do not grant EverPacket a license to host or analyze those contents merely by entering them locally.
You are responsible for the lawfulness, accuracy, appropriateness, and security of packet information. When you record another person's contact, dependent, healthcare-location, household, or other personal information, you represent that you have a lawful and appropriate basis to do so and to share any resulting output with the intended recipient.
Do not use EverPacket to store or distribute unlawful, infringing, threatening, fraudulent, abusive, discriminatory, or malicious content. Do not include passwords, passcodes, PINs, secret keys, complete financial-account numbers, payment-card data, Social Security or national-identification numbers, authentication answers, detailed medical records, or other secrets that should be kept in a purpose-built secure system. EverPacket may display guardrail warnings, but you remain responsible for what you enter.
13. Local storage, project files, and backups
The current implementation stores editable packet and project information in browser IndexedDB. It also uses browser local storage, session storage, cookies, Cache Storage, and service-worker components for preferences, consent choices, offline support, authentication, purchase setup, entitlement receipts, concurrency controls, and other functions described in the Cookie and Device-Storage Notice.
EverPacket does not currently encrypt packet contents in IndexedDB or the exported .EverPacket project-file format. The project file is a structured, human-readable data file that contains the packet information and operational metadata included in the export. Anyone who can access the browser profile, device account, downloaded file, cloud-drive copy, email attachment, removable media, backup service, or printed output may be able to read it.
You must:
use device login, disk encryption, screen lock, and account controls appropriate for the sensitivity of your information;
avoid shared or public devices unless you understand the risk;
keep a current project-file backup in a location you consider appropriately protected;
test periodically that the backup imports successfully;
delete or securely dispose of superseded files and printouts when appropriate; and
protect QR codes and contact cards as you would protect the information encoded in them.
A project-file import adds a local project; it is not cloud recovery. Import limits, file-format versions, and browser capabilities are described in the Digital Product, Delivery, Compatibility and Local-Storage Disclosure.
14. Generated outputs and sharing
PDFs, contact cards, QR codes, and other outputs are generated in your browser from local packet information. Generated files are saved, printed, shared, or transmitted through software and services you choose. EverPacket does not control the operating system download folder, print queue, email service, messaging service, cloud drive, QR scanner, recipient device, or later copies.
A QR code or contact card may reveal its embedded information to anyone who scans or opens it. A printed packet may be copied, photographed, misplaced, or read by unintended people. Review every output before sharing and limit distribution to people who need it.
Generated outputs are organizational aids, not authoritative records or instructions from a professional. Verify names, numbers, dates, locations, official documents, prescriptions, emergency instructions, and legal or financial information from primary sources.
15. Output authorization and refund evidence
During an applicable voluntary refund window, the Service may require a short-lived online authorization before generating a paid output. A lawful refund decision must be based on a successfully completed paid output, not merely an authorization request or attempted render. The separate Refund, Cancellation and Withdrawal Policy defines what counts as completion and preserves mandatory consumer rights.
If the Service records an output as completed when generation failed, contact support. We will investigate and correct the refund assessment as appropriate. This clause does not limit a statutory remedy.
16. Availability, offline behavior, and updates
We aim to provide a reliable local-first application, but the Service may be unavailable or impaired because of maintenance, provider outages, browser changes, device limitations, connectivity, security response, legal restrictions, or events outside our reasonable control.
A service worker may cache selected application-shell and public pages for offline use. Cached pages may not be the latest legal or product information. A purchase must use the live, versioned legal documents presented in the checkout review. When an application update is available, the Service may ask you to reload after local saves finish.
You must install or allow updates within a reasonable time when they are needed for security, compatibility, legal compliance, file-format support, or conformity. We will provide information about the purpose and consequences of a required update where applicable law requires it. We are not responsible for a loss caused solely by an unreasonable failure to install a properly supplied required update after clear notice, to the extent applicable law permits.
17. Compatibility
The Service requires a reasonably current browser with JavaScript, IndexedDB, local storage, cookies for account functions, file import/export, Blob and download support, and PDF/print capabilities. The product is tested against representative current desktop and mobile engines, but testing is not a guarantee of compatibility with every browser build, embedded browser, assistive technology, operating system, printer, storage policy, enterprise restriction, or device.
Private-browsing modes, content blockers, disabled cookies, disabled JavaScript, browser storage quotas, automatic storage eviction, restricted file downloads, aggressive power management, or embedded in-app browsers may prevent or limit features. Review the current Compatibility Disclosure before purchase.
18. Support and support attachments
Product support is available through support@everpacket.com or another support channel displayed in the Service. Support may request content-blind diagnostic information, such as your browser family, operating-system family, application version, generic error code, transaction or case reference, approximate time of the problem, and the steps that produced it. EverPacket cannot inspect, repair, recover, or restore packet contents that it does not receive.
When an EverPacket support form specifically displays an attachment control, you may submit one optional PNG or JPEG image no larger than 15 MiB. The image may be used only to show a redacted view of the application shell, a generic error state, or another content-free interface, browser, payment, or support problem. Files sent by email, public link, chat, developer ticket, or another channel are not authorized support attachments.
You must not submit:
an .EverPacket project file;
a generated packet PDF or any other generated packet output;
a vCard, contact card, or QR output file;
a screenshot containing a QR payload;
a screenshot showing packet entries or packet-derived information;
passwords, passcodes, authentication codes, credentials, secret keys, recovery links, or recovery codes;
payment-card, bank-account, or other payment information;
Social Security numbers, national-identification numbers, government identification, or identification documents;
medical information, healthcare details, or records; or
household information, addresses, contact details, dependent information, or other unnecessary sensitive information.
You are responsible for reviewing the entire visible image and removing, covering, or replacing all prohibited and unnecessary information before upload. EverPacket validates the file’s size, declared media type, and file signature and re-encodes accepted images to remove source-file metadata. These technical checks do not inspect or guarantee that the visible image is free of sensitive information.
A permitted support attachment is an intentional and limited exception to EverPacket’s normal local-only data boundary. The image is stored privately with the applicable support case in a case-linked storage bucket operated through Supabase. Access is limited to authorized EverPacket personnel and service providers whose responsibilities require access for support, security, legal compliance, or protection of the Service.
By submitting a permitted support attachment, you give EverPacket a limited permission to host, access, reproduce, and use the image only as reasonably necessary to investigate and resolve the case, maintain security, comply with law, and administer applicable retention or legal-hold requirements. You do not give EverPacket permission to use the attachment for advertising, profiling, unrelated analytics, or model training.
EverPacket may stop reviewing, contain, or delete an attachment that appears to include prohibited information or that is not reasonably necessary for the support request. Permitted support attachments are retained under the separate attachment schedule stated in the Privacy Policy and may be preserved longer when subject to a documented legal hold or another legal requirement.
19. Acceptable use and security
You may not:
access or test non-public systems without written authorization;
interfere with rate limits, authentication, purchase verification, entitlement controls, legal-acceptance records, refund evidence, audit records, or provider webhooks;
introduce malware, exploit code, automated abuse, or content intended to disrupt the Service;
impersonate another person, use an email address you do not control, or fraudulently claim a purchase;
use the Service to violate privacy, intellectual-property, consumer-protection, export-control, sanctions, anti-fraud, or other law; or
use automated means to extract, reproduce, or train on protected product content except as expressly permitted by us in writing or by non-waivable law.
Good-faith security research must follow any published vulnerability-disclosure policy and must not access another person's data, disrupt service, or exploit a vulnerability beyond what is necessary to demonstrate it.
20. Intellectual property
EverPacket and its licensors own the Service and all associated intellectual-property rights, excluding information you lawfully provide and third-party materials identified as such. EverPacket, product names, logos, and trade dress may not be used without permission except for truthful nominative reference.
You may make reasonable personal copies of generated outputs and project files for your household-continuity purposes. Templates, prompts, interface text, software, and documentation may not be republished or sold as a competing or standalone product.
If you provide feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without identifying you or disclosing packet content, provided we do not use confidential information you clearly identify as confidential.
21. Third-party services and open-source components
The Service depends on third parties for hosting, authentication, payment, email, database, content delivery, and other infrastructure. Those providers may change, experience outages, or impose their own terms. Our Privacy Policy identifies material providers and processing roles.
Open-source components remain subject to their applicable licenses. Nothing in these Terms restricts rights granted directly by an open-source license.
Links to third-party services are provided for convenience and do not imply endorsement. We are not responsible for third-party products, privacy practices, content, or availability, except where mandatory law makes us responsible.
22. Privacy and device storage
Our Privacy Policy explains the personal information EverPacket processes as the operator of the Service. The Cookie and Device-Storage Notice explains cookies, IndexedDB, local storage, session storage, Cache Storage, and similar technologies. The Consumer Health Data Privacy Notice explains EverPacket’s local processing of health-related packet information and the additional rights and controls that may apply.
Optional product analytics and first-party marketing measurement are disabled unless permitted by your current analytics choice and browser privacy signals. One optional choice governs both the content-blind product events and the first-party campaign-attribution and text-slot experiment records described in the Privacy Policy. When allowed, EverPacket may use random browser identifiers and closed categories for actions such as page or section category, output type, CTA category, normalized campaign source, and experiment exposure. The current design recognizes Global Privacy Control and Do Not Track as overriding opt-out signals. These systems are designed to exclude packet values, names, contact details, notes, search text, filenames, generated-output contents, full URLs, raw referrer URLs, DOM capture, session replay, exception text, and other free text. Launch ad-platform synchronization imports aggregate campaign delivery and spend data and does not upload EverPacket account email, packet data, account identifiers, or EverPacket visitor identifiers to Meta or Google.
23. Refunds, withdrawal, cancellation, and remedies
The Refund, Cancellation and Withdrawal Policy states the voluntary EverPacket refund promise and region-specific withdrawal information. Mandatory consumer rights always take priority over a conflicting limitation in these Terms or that policy.
The voluntary standard policy is intended to offer a full refund when a valid request is made within 14 calendar days after verified payment and no paid output has been successfully completed, subject to fraud, duplicate, chargeback, and risk review. A free emergency sheet does not count as a paid output. The exact policy version accepted for your transaction controls the voluntary promise.
Consumers in some regions have additional rights relating to cooling-off periods, immediate supply of digital content, conformity, updates, repair, replacement, price reduction, cancellation, or damages. We will request any separate express consent or acknowledgment required before immediate digital supply. A checkbox agreeing to general terms is not treated as a substitute where law requires a distinct consent.
24. Suspension, entitlement status, and account deletion
We may restrict online account or purchase functions when reasonably necessary to address suspected fraud, dispute, refund, sanctions, unlawful use, credential compromise, security risk, or a legal obligation. We will use proportionate measures and provide notice or a review route when required by law and reasonably practicable.
A verified refund or payment reversal may end the paid entitlement. A dispute may place the entitlement on hold while the transaction is reviewed. Local packet contents already on your device are separate from the account and are not remotely deleted by EverPacket; however, paid output features may require a valid entitlement.
You may request account deletion through available account controls or support, subject to recent authentication and completion of open transaction work. Account deletion does not delete local packets, downloaded files, printouts, or data held independently by the Payment Merchant or identity provider. We may retain or de-link transaction, legal-acceptance, consent, fraud-prevention, security, tax, refund, dispute, and audit records where required or permitted by law. A purchase may be released to a verified recovery process as described at deletion time.
25. Disclaimers
To the maximum extent permitted by law, the Service is provided on an as available basis. We do not promise that the Service will be uninterrupted, error-free, compatible with every device, or that a packet or output will identify every household need or prevent harm.
We disclaim implied warranties only to the extent the law permits. We do not exclude or limit any warranty, guarantee, conformity obligation, duty of care, or remedy that cannot lawfully be excluded, including mandatory rights under applicable consumer law.
Nothing in the Service is legal, medical, financial, insurance, tax, cybersecurity, emergency, or other professional advice. In an emergency, use official emergency services and follow qualified professional instructions.
26. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, intentional misconduct, gross negligence where non-waivable, death or personal injury caused by negligence where non-waivable, violation of a mandatory consumer right, or any other liability for which a limitation is prohibited.
Subject to the preceding paragraph, and to the maximum extent permitted by law:
EverPacket is not liable for indirect, incidental, special, exemplary, punitive, or consequential losses; loss of profits or revenue; loss of opportunity; or loss, exposure, or corruption of locally stored packet data, project files, printouts, or generated outputs caused by device loss, browser clearing, storage eviction, shared-device access, third-party services, or failure to maintain backups; and
EverPacket's aggregate liability arising from a paid transaction will not exceed the greater of the amount you paid for that transaction or USD 100.
The exclusions and cap do not apply to a remedy or damage measure that mandatory law makes available. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent enforceable where you live.
27. Indemnity for prohibited or unlawful use
To the extent permitted by law, and excluding ordinary personal consumer use, you agree to reimburse EverPacket for third-party claims, losses, and reasonable costs arising from your intentional unlawful use, infringement of another person's rights, unauthorized commercial exploitation, or material violation of Section 19. This obligation does not require a consumer to indemnify us for our own negligence, legal violation, product defect, or breach of these Terms.
28. Governing law and disputes
Before filing a formal claim, please contact support@everpacket.com with a concise description and requested resolution. We will try in good faith to resolve the issue. This informal step does not shorten a limitation period or prevent urgent relief, a charge dispute, a regulator complaint, or use of a mandatory consumer process.
Except where mandatory law gives you the protection of another law or forum, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes may be brought in state or federal courts located in San Diego County, California. Consumers may also bring a claim in any local court or forum that mandatory law makes available.
These Terms do not require arbitration and do not waive a right to participate in a class, representative, collective, public-injunction, or similar proceeding where such a waiver would apply. The parties may voluntarily agree to mediation or arbitration after a dispute arises.
29. Export controls, sanctions, and geographic availability
You may not use, export, re-export, or provide the Service in violation of United States export-control or sanctions laws or applicable local trade restrictions. The Payment Merchant may block transactions in countries or with persons it cannot serve. EverPacket may also restrict availability when legal, tax, consumer, privacy, localization, security, or operational requirements are not satisfied.
A payment method being technically accepted does not mean EverPacket is legally launched in every jurisdiction. The initial paid launch is limited to transactions for which the Payment Merchant’s final record reports a United States billing country. A Cloudflare-provided country signal is a preliminary gate, not the final eligibility record. When the Payment Merchant reports verified payment and a United States billing country, EverPacket will ordinarily activate and fulfill the purchase; later access from another country does not by itself revoke the license. If the Payment Merchant’s final record reports a billing country outside an approved market, EverPacket will not activate the paid entitlement and will arrange a prompt full refund through the Payment Merchant after provider reconciliation. Knowingly providing false country or billing information or bypassing geographic controls is a material breach and may result in investigation, suspension, cancellation, or refund, but it does not waive a mandatory consumer right or eliminate liability that applicable law does not permit EverPacket to exclude.
30. Changes to the Service or Terms
We may modify the Service and these Terms prospectively. We will post the new version and effective date. For minor, administrative, clarifying, formatting, or other non-material changes that do not materially reduce an existing paid right, change the price or refund promise for a completed purchase, or materially expand how EverPacket handles personal information, posting the updated version is ordinarily sufficient and we do not ordinarily send an individual email or in-product notice. We will provide additional notice or obtain consent when required by law or when a change is material.
The version accepted for a completed purchase remains available in an immutable or otherwise reliable archive. New terms will not retroactively change the price, refund promise, or core license of a completed purchase unless you expressly agree or mandatory law requires the change.
We may make an immediate change needed for security, legal compliance, provider requirements, or to prevent abuse. Where practical, we will explain the change and its effect.
31. Electronic communications and records
You consent to receive transaction, account, security, legal, and support communications electronically at the email address or in-product channel associated with your account or purchase, subject to applicable electronic-signature and consumer-notice laws. You may withdraw consent to purely electronic records where law provides that right, but doing so may require closing online account functions if no lawful practical alternative exists.
At initial launch, EverPacket does not operate a non-U.S. email availability list and does not collect non-U.S. email addresses for launch notices. An unsupported-country page may record only a content-free country or region interest count and may provide ordinary outbound links to EverPacket social profiles. That action does not create an account, reserve a price, authorize email, or promise a launch date. Any future availability or product-news email program will be introduced only after the applicable collection notice, consent, sender-identification, and unsubscribe controls are operational. Marketing consent is not required to purchase or use the Service.
Keep a copy of your receipt and accepted documents. We will provide or make available a durable copy of required transaction information and any immediate-supply or withdrawal acknowledgment where law requires it.
32. General terms
If a provision is unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign a paid license except with our consent or where mandatory law permits transfer. We may assign these Terms as part of a bona fide sale, reorganization, or transfer of the Service, subject to applicable privacy and consumer law.
These Terms and incorporated documents are the entire agreement about the Service, except for a separate written agreement signed by both parties. Headings are for convenience. Including means including without limitation. A translated version may be provided for a market; where local law requires a local-language version to control, that version controls for that market.

Payment Merchant The legal entity identified by Stripe or Link at checkout and on the receipt is the merchant of record for the transaction. Its legal name, address, payment terms, and transaction-support channel are displayed in the hosted checkout or receipt.
